Terms and Conditions

1. Introduction

Welcome to MarsPay. These terms and conditions govern your access to and use of our services. By creating an account and using our platform, you agree to be bound by these terms. If you do not agree, please discontinue using our services.

2. Definitions

  • "MarsPay" refers to our platform, which facilitates cross-border payments.
  • "Services" refers to all products, platforms, software, and services provided by MarsPay.
  • "User" refers to individuals who create an account and use MarsPay.

3. Eligibility

  • Users must be at least 18 years of age or have reached the legal age in their country to enter into a binding agreement.
  • You are responsible for ensuring that your use of MarsPay complies with all applicable local laws and regulations.

4. Account Registration

  • Users must provide accurate, up-to-date information during registration. Failure to maintain accurate information may result in suspension or termination of services.
  • You are responsible for the confidentiality and security of your account credentials. Notify MarsPay immediately if you suspect unauthorized access to your account.

5. Services and Usage

  • Service Scope: MarsPay enables cross-border payments between the United States and India, allowing users to send and receive payments via UPI and forex cards.
  • User Responsibility: You are responsible for all activities conducted through your account. MarsPay is not liable for any unauthorized activity unless it is a result of our negligence.
  • Prohibited Activities: You may not use MarsPay for illegal activities, including but not limited to fraud, money laundering, or terrorist financing. Violations may result in account suspension and reporting to legal authorities.

6. Fees and Charges

  • Conversion Fee: MarsPay charges a flat 2.99% fee for USD to INR conversions and 0.5% for INR to USD conversions. These fees are deducted at the time of deposit.
  • Transaction Fees: No additional transaction fees are applied to payments made through MarsPay after the conversion.
  • All fees are subject to change, and you will be notified in advance of any updates.

7. Compliance with Laws

  • KYC/AML: MarsPay follows Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations. Users may be required to submit additional documentation for identity verification.
  • Reporting to Authorities: MarsPay reserves the right to report any suspicious activities to relevant legal authorities in compliance with KYC/AML laws.

8. Security

  • Data Protection: MarsPay uses encryption and other security measures to protect user data and transactions. However, we cannot guarantee absolute security, and users must notify us of any security breaches.
  • Account Responsibility: Users are responsible for maintaining the security of their login credentials. MarsPay is not liable for losses due to unauthorized account access unless caused by a security lapse on our side.

9. Termination of Services

  • User-Initiated Termination: You may terminate your account at any time by contacting MarsPay's support team. Termination will not absolve you of any pending fees or obligations.
  • MarsPay-Initiated Termination: MarsPay reserves the right to terminate or suspend accounts for violations of these terms, including illegal activities or non-compliance with KYC/AML regulations.

10. Limitation of Liability

  • Service Interruptions: MarsPay will make reasonable efforts to ensure service availability but is not liable for interruptions caused by maintenance, technical issues, or third-party service providers.
  • No Warranty: MarsPay provides services “as is” and does not guarantee that the platform will meet your needs or be error-free.
  • Indirect Damages: MarsPay is not responsible for indirect, consequential, or punitive damages arising from the use of our services.

11. Indemnification

You agree to indemnify and hold harmless MarsPay, its affiliates, directors, officers, and employees from and against any claims, damages, losses, or legal proceedings arising from your use of the services or your violation of these terms.

12. Intellectual Property

  • MarsPay Ownership: All content, software, and technology used in the MarsPay platform are the intellectual property of MarsPay. You may not copy, modify, or distribute any part of the platform without explicit permission.
  • User Content: By submitting content (e.g., feedback or reviews), you grant MarsPay a worldwide, royalty-free license to use, reproduce, and distribute your content.

13. Dispute Resolution

  • Arbitration Clause: Any disputes arising out of or related to these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
  • Jurisdiction: For users in the United States, disputes will be governed by the laws of the state where MarsPay is headquartered. For Indian users, disputes will be governed by Indian law.

14. Governing Law

These terms will be governed by and construed in accordance with the laws of the United States and India, depending on the user's location and the nature of the transaction.

15. Amendments

MarsPay reserves the right to modify these terms at any time. Changes will be communicated via email or through the platform, and continued use of MarsPay constitutes acceptance of the revised terms.
